Terms of Service

These Terms of Service ("Terms") govern your access to and use of Prompt Builder — the web application, the desktop applications (macOS, Windows, Linux), and related services (together, the "Service"), operated by Paulo Mendes ("we", "us", "our"). By creating an account, launching the app, or purchasing a plan, you agree to these Terms. If you do not agree, do not use the Service.

Prompt Builder is a tool for composing and managing generative-AI prompts. The full prompt-building engine is available free of charge on web and desktop. A paid "Pro" plan unlocks additional features (see Section 4). The Service does not itself generate images; the optional in-app generation feature connects to an image-generation server that you run or control (e.g. a local Automatic1111/Forge or ComfyUI instance). We are not responsible for those third-party tools or their output.

Some features (cloud sync, Pro, the community marketplace) require an account. Authentication is provided through Firebase Authentication. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

You must be at least 16 years old (or the minimum age of digital consent in your country) to create an account. You agree to provide accurate information and to keep it current.

The Pro plan is offered as a monthly subscription, an annual subscription, or a one-time lifetime purchase, at the prices shown at checkout. Subscriptions renew automatically at the end of each billing period until cancelled.

Payments are processed by our payment partners — Stripe and/or Lemon Squeezy. Lemon Squeezy acts as the merchant of record for purchases made through it, meaning it is the seller for that transaction and is responsible for collecting and remitting applicable VAT and sales taxes. Your purchase through that provider is also subject to its buyer terms. We do not receive or store your full payment-card details.

Prices may change; any change will apply only to future billing periods and we will give reasonable notice. A "lifetime" purchase grants Pro access for the operational lifetime of the Service and is not a perpetual guarantee that the Service will exist forever.

You may cancel a subscription at any time from your account menu or via the payment provider’s customer portal. On cancellation you retain Pro access until the end of the period you have already paid for; we do not provide pro-rated refunds for the unused part of a billing period unless required by law.

If you are a consumer in the EU/UK, you have a statutory 14-day right of withdrawal on new purchases. Because the Service is digital content supplied immediately, by purchasing and starting to use Pro you acknowledge that this right may be lost once access has been provided, except where the law provides otherwise.

To request a refund or exercise a withdrawal right, contact us at support@promptbuilderlabs.com, or use the refund process of the payment provider you bought through. Refund decisions for merchant-of-record purchases are handled together with that provider.

You agree not to use the Service to:

• break any applicable law or infringe anyone’s rights, including intellectual-property rights;
• create, store, or share content that is unlawful, or that sexualises minors or any real person without consent;
• upload malware, attempt to gain unauthorised access, or disrupt the Service or its infrastructure;
• resell, sublicense, or commercially exploit the Service except as expressly permitted.

You are solely responsible for the prompts you write and the images you generate using your own tools. The Service is a text-composition utility and does not produce imagery.

The Service lets you create configuration libraries ("packs") and, optionally, publish them to a community marketplace. You retain ownership of the content you create. By publishing a pack you grant us and other users a non-exclusive, worldwide, royalty-free licence to store, display, and use that pack within the Service for the purpose of operating the marketplace.

You represent that you have the right to publish what you submit. We may remove, restrict, or refuse any user content — including content reported by other users — at our discretion, particularly where it violates Section 6. We do not pre-screen user content and are not responsible for it.

The Prompt Builder software, branding, and website are owned by Paulo Mendes and protected by intellectual-property laws. These Terms grant you a limited, revocable, non-transferable licence to use the Service for its intended purpose. They do not transfer any ownership in the Service to you.

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any data will never be lost. You are responsible for keeping your own backups of important configurations (the app supports local export).

To the maximum extent permitted by law, Paulo Mendes will not be liable for any indirect, incidental, special, or consequential damages, or for lost data, profits, or goodwill, arising from your use of the Service. Where liability cannot be excluded, our total aggregate liability is limited to the greater of the amount you paid us in the 12 months before the claim, or USD 50. Nothing in these Terms limits liability that cannot be limited by law (such as for fraud or for your statutory consumer rights).

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or use the Service unlawfully. On termination, the licences granted to you end; sections that by their nature should survive (e.g. intellectual property, disclaimers, limitation of liability) will survive.

We may update these Terms from time to time. If we make material changes we will update the date above and, where appropriate, notify you. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of Portugal, without regard to its conflict-of-law rules, and the courts of Portugal will have jurisdiction, except where mandatory consumer-protection law in your country of residence provides otherwise.
